Terms of service

Before ordering a plan with Innocent Sky you must be aware of the following terms. This page may be updated at any time so it is your own responsibility to make sure you are up to date with the latest version. Failure to abide by these terms may lead to suspension or termination without a refund depending on the severity of your actions. Please also note that you are responsible for any hostees that you may have.

Orders

Before you send your order please double check that the information you are sending to us is all correct to save time. Once you send in an order form we will send you a confirmation email and then an invoice to be paid via PayPal in USD. Currently the only payment we can accept is PayPal unless you reside in Australia. After you receive your invoice you will have 5 days to pay it or the order will be cancelled and we will not accept orders from you again unless you notify us of your change of mind.

For Australian residents only, money orders are available as well as Paypal. Please make sure you let us know you intend to pay via money order if that is the case when placing your order so we can provide an address for you to send it to.

If you are 13 or younger, please make sure you have your parents permission before placing an order.

All orders received are processed manually and checked thoroughly to be sure there are no mistakes.

Down time and data loss

Unfortunately down time and data loss is a possibility and we cannot be held responsible for any of it since it is out of our hands. We will be working hard to prevent this from happening and fix any problems that may occur. It is your sole responsibility to do weekly backups and make sure any of your hostees do the same.

Monthly Billing

Monthly billing has been newly introduced but is not available for all packages. This is only available for those who already have a domain. It is your responsibitly to make sure you pay your monthly hosting fee. When your bill is due will be every month from the date you first purchased your package. For example, if you purchased your package on the 10th of November your payment is due on the 10th of every month after that. You have 7 days to pay via paypal to payments@innocentsky.com after your due date. Failure to do so will result in account suspension until the bill is paid. If you have any troubles making the payment when due please let us know as soon as possible and you may be granted an extension. Refunds are not available with monthly billing unless we see fit.

Free Hosting

We are very pleased we can offer free hosting to a selection of people with various types of sites. We can not offer free installations though we are willing to help you at all times when and where you need help. Most of the terms do apply to free hosted clients as well as paid so you are required to keep up to date with them. All hostees will be deleted if you violate any of these terms or do not update your site within 2 months. We are not willing to host sites that do not update and waste space that may be better used by other hostees. Not all that apply will be accepted. It all depends of the level of skill you have whether or not you will be accepted. We can not determine if you will or will not be accepted if you simply chat to us, you will need to apply before we can make an informed decision. You may choose to cancel your free hosting at any time should you wish by simply emailing us. There will be no cancellation fee ever.

Banned Content

While some content restrictions have been lifted, we ask that you please refrain from stealing, copying and redistributing any other sites content. In the event of a complaint being made to us about the type of content you are uploading to your site we will ask, that the content in question be removed immediately.

In addition, the following is strictly forbidden to be uploaded on our server:

Illegal content (i.e. warez)

Mature content (i.e. including pornography and obscene material)

Hateful, bullying, harassment, or harmful content

Proxies and PHPizabi/YaBB Forums scripts

MP3/MP4/AVI or any other video/music not approved by us.

Cancellation, terminations and suspensions

Innocent Sky reserves the right to suspend or terminate your account with out notice or refund if you breach these terms and conditions. This will be decided depending on the severity of your actions. If suspension has occurred you will either have to wait for the suspension to end (2 weeks) or pay an unlocking fee of $10.

If you have bought hosting and a domain from us you may choose to cancel your hosting package with us at any time by simply emailing us. If you have purchased a domain from us and you choose to move to a new host, you will need to notify us of your new nameservers so we can change them for you at no extra cost. If for any reason you are unhappy being hosted with us, we ask that you talk to us before making the decision to change hosts.

Once your account has been deleted, all of your files will be too. There is no way to reclaim or recover them. If you choose to be hosted here again, you will have to repay for as if you were a new client.

Custom Nameservers

Custom nameservers are only available for reseller and master reseller packages. A small fee of $2.50 for an NS1 and NS2 will apply. Innocent Sky does not profit from this fee. Please email us for more information or to order the custome nameservers.

Refunds

Innocent Sky will gladly refund your purchase less the cost of the domain name (if package comes with a domain name) within seven days of receiving your payment if you change your mind. No refunds will be giving after that time unless we see fit.

Unlimited/ Unmetered

When we say unlimited it means unmetered. We do not record how much bandwidth/space you are using but if too much is being used that it interrupts other clients or the server load you will receive a warning. If the problem continues you will be limited to space and/or bandwidth.

$0 Installations

Free installations are only available to paid clients. Installations may include but are not limited to: BellaBuzz, Fanupdate, Wordpress etc. We do not know how to install everything but are willing to find out how if you require something installed that we are not familiar with, though some exceptions may apply. If in doubt ask first.

specials

Special offers are for a strictly limited time only, no exceptions. In order to redeem an offer you must quote the coupon code or normal price may apply. If you purchase a package using a coupon code no refunds will be given. Your plan will be the regular cost next yearly payment.

Domains

Most of our hosting plans come with a domain which is included in the cost. No domains are free unless you win one in a contest we hold. All domains belong to Innocent Sky even if you change hosts. Before choosing a domain name you must make sure that the domain name is available. All hosting packages are to be paid yearly to receive a domain name. If you would like a monthly plan please contact us and we may be able to work something out. If you do not require a domain name you may deduct $5 from the total price of any reseller of large packages.

Unfortunately we cannot change ownership of any domains registered with us. This means that we cannot transfer domains we register in our account to an account of yours. This may be subject to change if we can figure out a way to safely transfer domains to you.

If your hosting service was terminated due to violation of any of the terms, any domain that was given to you upon purchase of a reseller or large hosting package by Innocent Sky will remain in our possession and we have the right to sell, give away or use the domain that was given to you.

Privacy Policy

Any personal information collected by Innocent Sky (including your paypal email address) will under no circumstance be shared with anyone else unless required to do so by law.
